These Terms of Service govern your use of the Caring Hands Home Health TX LLC website and the home care services we provide. Please read these terms carefully. By using our website or engaging our services, you agree to be bound by these terms.
Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Caring Hands Home Health TX LLC ("Caring Hands," "we," "us," or "our"), a Texas limited liability company operating as a licensed Home and Community Support Services Agency (HCSSA) under HHSC License #023937.
By accessing our website at caringhandshomehealthtx.com, contacting our office, scheduling services, or receiving care from our team, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you are accessing our services on behalf of another individual (such as an elderly parent or family member), you represent that you have the authority to agree to these Terms on their behalf.
Services We Provide
Caring Hands Home Health TX LLC is a licensed non-medical Personal Assistance Services (PAS) agency providing the following home care services in the greater Austin, Texas area:
- Personal Care: Assistance with bathing, dressing, grooming, and personal hygiene
- Companion Care: Companionship, socialization, and emotional support
- Respite Care: Temporary relief for primary family caregivers
- Live-In and 24/7 Care: Around-the-clock in-home support
- Medication Reminders: Non-clinical reminders to take prescribed medications
- Light Housekeeping: Tidying, laundry, and basic household tasks
- Meal Preparation: Planning and preparing nutritious meals
- Transportation Assistance: Coordination via approved third-party providers
- Errand and Shopping Assistance: Running errands and grocery shopping
All services are provided in accordance with an Individualized Service Plan (ISP) developed collaboratively with the client and/or authorized family representative.
Scope and Limitations of Services
Caring Hands Home Health TX LLC is a non-medical agency. We do not provide skilled nursing, medical care, wound care, injections, or any services requiring a medical license.
The following limitations apply to all services we provide:
- We do not provide services to minor children (individuals under 18)
- We do not bill Medicaid or the Community Attendant Program (CAP)
- We are a private pay agency; clients are responsible for all service fees
- We may accept long-term care insurance and provide invoices for reimbursement claims
- Caregivers are prohibited from transporting clients in personal vehicles; transportation is coordinated through approved third-party providers only
- Our service area is limited to Pflugerville, Austin, Round Rock, Cedar Park, Georgetown, and surrounding areas within Travis and Williamson counties
- Caregivers may not administer medications, perform medical procedures, or give clinical advice
Client Rights and Responsibilities
Client Rights
As a client of Caring Hands Home Health, you have the right to:
- Receive respectful, dignified, and compassionate care at all times
- Participate in developing and modifying your Individualized Service Plan
- Be informed of all services, costs, and any changes to your care plan
- File a complaint or grievance without fear of retaliation
- Receive services from trained, background-checked caregivers
- Request a change of caregiver if necessary
- Discontinue services at any time with proper notice
Client Responsibilities
To ensure safe and effective service delivery, clients agree to:
- Provide accurate and complete information about care needs, health status, and home environment
- Maintain a safe environment for caregivers, including disclosing any hazards or risks
- Treat all Caring Hands staff with respect and dignity
- Provide timely notice of schedule changes, cancellations, or service modifications
- Pay all invoices and fees in accordance with the agreed payment schedule
- Not request caregivers to perform tasks outside the agreed scope of services
- Not attempt to hire Caring Hands caregivers directly outside of the agency
Payment Terms
Caring Hands Home Health TX LLC operates on a private pay basis. All service fees are agreed upon prior to the start of services and outlined in the Service Agreement.
Billing and Payment
- Invoices are issued weekly or bi-weekly as agreed in your Service Agreement
- Payment is due within 7 days of invoice date unless otherwise agreed
- Accepted payment methods include check, bank transfer, and other methods outlined in your Service Agreement
- Late payments may result in temporary suspension of services
Long-Term Care Insurance
If you have long-term care insurance, we will provide detailed invoices to support your reimbursement claim. Caring Hands does not bill insurance companies directly; the client is responsible for all payments and reimbursement claims with their insurance provider.
Transportation Services
Transportation services must be requested at least 48 hours in advance and paid for at least 24 hours before the scheduled service. Transportation is limited to approved appointments and essential activities.
Scheduling, Cancellations, and No-Shows
Scheduling
Services are scheduled through your care coordinator or the Caring Hands office. A free in-home assessment is conducted prior to the start of services to develop your Individualized Service Plan.
Cancellations
- Cancellations must be made at least 24 hours in advance
- Late cancellations (less than 24 hours notice) may be subject to a cancellation fee as outlined in your Service Agreement
- Emergency cancellations will be handled on a case-by-case basis
No-Shows
If a caregiver arrives for a scheduled visit and is unable to gain access or the client is unavailable without prior notice, a no-show fee may apply as outlined in the Service Agreement.
Caregiver Employment and Conduct
All Caring Hands caregivers are employees or authorized contractors of Caring Hands Home Health TX LLC. We conduct comprehensive screening of all caregivers including:
- Texas DPS criminal history background check
- Nurse Aide Registry (NAR) check
- Employee Misconduct Registry (EMR) check
- OIG exclusion check
- Sex offender registry check
- Drug screening and TB test
- Reference verification
All caregivers are supervised by our Director of Nursing, Daneisha Ford RN, and are trained in accordance with HHSC requirements.
Non-Solicitation
Clients agree not to directly hire, solicit, or engage any current or former Caring Hands caregiver for private employment for a period of 12 months following the termination of services. Violation of this provision may result in a placement fee equal to 20% of the annual compensation offered to the caregiver.
Website Use
By accessing our website at caringhandshomehealthtx.com, you agree to use it only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the website in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to any part of the website or its related systems
- Transmit any unsolicited commercial communications or spam
- Reproduce, duplicate, or copy any content from our website without permission
- Use automated tools to scrape, crawl, or extract data from our website

Communications and SMS Consent
By providing your phone number to Caring Hands, you consent to receive communications from us including appointment confirmations, care reminders, follow-up messages, and informational updates via SMS text message and email.

Phone calls to our office may be recorded for quality assurance and training purposes. By calling, you consent to the recording of the call.
Liability and Disclaimers
Caring Hands Home Health TX LLC provides non-medical personal assistance services only. We are not responsible for medical outcomes, clinical decisions, or health conditions of clients.
Limitation of Liability
To the fullest extent permitted by applicable law, Caring Hands Home Health TX LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services, including but not limited to personal injury, property damage, or financial loss, except in cases of gross negligence or willful misconduct.
Our total liability for any claim arising from our services shall not exceed the total fees paid by the client in the 30 days preceding the incident giving rise to the claim.

Indemnification

Termination of Services
Client-Initiated Termination
Clients may discontinue services at any time by providing written or verbal notice to our office. We request at least 72 hours advance notice to allow for proper care transition planning.
Agency-Initiated Termination
Caring Hands reserves the right to discontinue services in the following circumstances:
- Non-payment of outstanding invoices
- Verbal or physical abuse of caregivers or staff
- Client requests that fall outside our scope of services
- Safety concerns in the home environment that cannot be resolved
- Misrepresentation of care needs at intake
In non-emergency situations, we will provide reasonable notice and assist with care transition planning.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
Any disputes arising from these Terms or our services shall first be addressed through good faith negotiation between the parties. If a resolution cannot be reached, disputes shall be submitted to binding arbitration in Travis County, Texas, in accordance with the rules of the American Arbitration Association.
Nothing in this section prevents either party from seeking injunctive or emergency relief in a court of competent jurisdiction.
Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. For existing clients, we will provide reasonable notice of material changes.
Your continued use of our services after changes take effect constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
